Fuel Pricing Probe Escalates as Government Sues Midway Gas Over Subpoena Defiance

The Virgin Islands government has escalated its effort to obtain pricing and operational data from fuel retailers in the St. Thomas–St. John district, asking the courts to compel compliance after months of nonresponse to legally issued subpoenas.

In a lawsuit filed Monday, the Department of Licensing and Consumer Affairs and the Department of Justice said they are seeking a court order requiring the company behind Midway Gas to turn over records that were formally requested last fall. According to the filing, Zaza Convenient Center, LLC failed to respond to a subpoena issued in late October seeking extensive information related to fuel operations and pricing.

The subpoena requests records covering retail fuel sales, wholesale purchases, transportation and delivery costs, operating expenses and overhead, pricing methodologies, tax records, and compliance and regulatory filings, dating back to May 2020. The deadline for producing the information was November 28, 2025. “To date, Respondent has not produced any of the information,” the civil complaint states.

The legal action follows warnings issued by DLCA officials in November of last year, when the agency told lawmakers that the Department of Justice would assist in enforcing subpoenas against service stations in the St. Thomas–St. John district that had ignored the legally binding requests. At that time, DLCA reported that all gas stations on St. Croix had complied, while only two of the 29 stations in the St. Thomas–St. John district had submitted the required information.
