Federal prosecutors decline to seek death penalty for Dangleben

ST. THOMAS — Federal prosecutors have decided not to pursue the death penalty for Richardson Dangleben Jr., but are still considering whether to pursue the death penalty for two men accused of murdering a hurricane recovery contractor on St. Croix in 2018, according to U.S. District Court records.

The men, Enock Cole and Jiovoni Smith, are facing charges including use of a firearm during a crime of violence resulting in death, which could make them eligible for the death penalty if convicted.

On Wednesday, Assistant U.S. Attorney Daniel Huston requested more time to provide the court with notice of whether they will seek the death penalty.
